The subject of the basic course is the teaching of the legal case-solving method. This is understood as the fundamental ability to answer concrete, real-life questions correctly or in a justifiable manner by applying legal rules. This method is based in particular on the following principles: (i) the precise recording of the circumstances in life including the question, (ii) the acquisition of a case-related assessment standard from law and order (Art. 20 III GG) and (iii) the rhetorical orientation towards the recipient horizon. To this extent, law means the art of decision-making based on criteria. Only someone who has really mastered this method is a “real” lawyer.
The qualification imparted in the basic seminar is tested in the exam and expected in professional practice – but more presupposed in training than taught. It’s just simple in principle. Dealing with the law in an artful way raises a multitude of questions, which often cannot be answered alone. The event answers many of these questions and empowers attendees to be much better at dealing with the law, court decisions and learning materials afterwards.
The program contains (excerpts):
- Discussion on the steps for a legal expert case solution (with evaluation)
- Teaching discussion on the 5 steps of the expert opinion technique (question / major / interpretation / subsumption / conclusion) and the complex relationships between the steps;
- Exercise: Analysis of unknown legal regulations for facts, legal consequences – with subsequent transformation into a case-related examination standard
- Subject and implementation of legal client discussions using the example of evidence cases, i.e. Assessment of the facts and questions – then preparation and mediation of legal opinions to the client in expert opinion
This content enables you to determine your position with concrete conclusions for your own development.
The legal qualification acquired in the event can be used “every minute” of legal activity and in all areas of law. The legal context is only used for illustration purposes. Participation in the third semester is recommended.
An advanced seminar on the subject of “Argument and Argumentation” – solving problem cases – is also in preparation, as is an introductory event for freshmen.
